Intellectual Property Claim
HauliShop respects the intellectual property rights of others. If you believe that any content available on HauliShop infringes your copyright, trademark, or other intellectual property rights, please contact us using the procedure described below.
A. Reporting Intellectual Property Infringement
It is HauliShop's policy to review valid intellectual property infringement notices and, when appropriate:
-
Remove or disable access to content that we reasonably and in good faith believe infringes the intellectual property rights of another party; and
-
Take appropriate action regarding users, sellers, suppliers, or other parties who repeatedly infringe intellectual property rights.
For purposes of this policy, "Content" includes, but is not limited to, product designs, images, photographs, graphics, illustrations, text, logos, product descriptions, and other materials displayed on or accessible through HauliShop.
If you believe that Content available through our website infringes your copyright, trademark, or other intellectual property rights, please send us a written notice containing the following information:
-
Identification of the copyrighted work, trademark, or other intellectual property that you believe has been infringed, including any applicable registration numbers;
-
Identification of the allegedly infringing Content, including a description of the material and the specific URL or location where it appears on our website;
-
A description explaining why you believe the Content infringes your intellectual property rights;
-
Your full name and contact information, including your mailing address, telephone number, and email address;
-
A statement that you have a good-faith belief that the disputed use is not authorized by the intellectual property owner, its agent, or applicable law;
-
A statement, made under penalty of perjury, that the information contained in your notice is accurate and that you are the intellectual property owner or are authorized to act on behalf of the owner; and
-
Your physical or electronic signature.
Upon receiving a sufficiently complete notice, HauliShop may investigate the complaint and remove or disable access to the disputed Content when appropriate.
B. Counter-Notification
If Content has been removed or disabled as a result of a copyright infringement notice and you believe that the removal occurred because of a mistake or misidentification, you may submit a counter-notification.
A valid counter-notification should include:
-
Identification of the Content that was removed or disabled and the location where the Content appeared before it was removed or disabled;
-
A statement, made under penalty of perjury, that you have a good-faith belief that the Content was removed or disabled as a result of mistake or misidentification;
-
Your full name, mailing address, telephone number, and email address;
-
A statement consenting to the jurisdiction of the appropriate United States Federal District Court for the judicial district in which your address is located, or, if you reside outside the United States, a judicial district in which HauliShop may be found;
-
A statement that you will accept service of process from the person who submitted the original infringement notice or that person's authorized agent; and
-
Your physical or electronic signature.
If HauliShop receives a valid counter-notification, we may provide a copy to the party who submitted the original infringement claim.
In accordance with the Digital Millennium Copyright Act ("DMCA"), the removed Content may be restored within approximately 10 to 14 business days after receipt of a valid counter-notification unless the original complaining party informs us that it has filed a legal action seeking a court order to prevent the Content from being restored.
False or Misleading Claims
Please be aware that under Section 512(f) of the DMCA, a person who knowingly makes a material misrepresentation that Content or activity is infringing, or that Content was removed or disabled by mistake or misidentification, may be liable for damages, costs, and attorneys' fees.
